What is the law in Arkansas of abandoned property left at my residence after 90 days?
We had roommates move into a rent house with us, the lease was for one year My husband and I are the only ones who are on the lease we had a verbal agreement with our roommates. They up and left after a month and a half with out any notice and abandoned their personal property at my residence, it has been over 90 days. Is it now legally ours?
No.
You need to send them a letter (or an email if you don’t have a physical address) that gives them a specific amount of time to come and get their property. (You need to give them at least 10 days, but I generally recommend 20 days.) Explain that if they do not retrieve their belongings within that timeframe you will donate everything to charity.
I do not recommend that you keep anything and I don’t recommend that you sell the items. This can open you up to a lawsuit that would allow a judge to order you to return the property or the money. Give them proper written notice. And then donate everything to charity – you’ll get to take the charitable donations tax deduction at the end of the year and you won’t have anything that links you to your former roommates.

If you cannot get hold of these guys – YES! call the local sheriff. The thing is, what you are doing, is storing their stuff for free, and these kind of guys have a habit of coming out of the woodwork months later, and if you don’t have the stuff anymore, they could sue you. So, make sure you don’t just put it out for the garbage. Take pictures of the stuff, get Serial numbers on any electronics, and give them to the cops! Also, check your State’s laws on abandoned property! The cops will also tll you that!
